Conditions of Contract
If the passenger’s journey involves an ultimate destination or stop in a country other than the country of departure the Montreal Convention may be applicable and the Convention governs and in most cases limits the liability of carriers for death or personal injury and for delay, loss of or damage to baggage. See notices headed “Advice to International Passengers on Limitation of Liability” and “Notice of Baggage Liability Limitations - International and Domestic.”
1. Definitions; Scope of Contract. As used herein, "carriage" is equivalent to "transportation," "carrier" means any air carrier that carries or undertakes to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage, and "Montreal Convention" means the Convention for the Unification of Certain Rules for International Carriage by Air, adopted on May 28, 1999 at Montreal, Canada. Carriage is subject to the rules and limitations relating to liability established by the Montreal Convention unless such carriage is not "international carriage" as defined by the Convention, and “ticket” means this Passenger Ticket and Baggage Check, of which these conditions and the foregoing notices and advice form a part. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of employees, agents and representatives of carrier and any person whose aircraft is used by carrier for carriage and its employees, agents and representatives.
2. Passengers with Disabilities. Passengers with disabilities are encouraged to make direct contact with carrier at their earliest convenience to advise carrier of such accommodations as may be necessary in light of the passenger’s disability. In particular, communication of requests for specific seating accommodations is encouraged at the earliest opportunity.
3. Delivery of Checked Baggage. Checked baggage will be delivered to the bearer of the baggage check. In case of damage to baggage moving in international transportation, complaint must be made in writing to carrier forthwith after discovery of damage and, at the latest, within seven days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered. See additional information below regarding baggage liability, weight and size limitations.
4. General Conditions of Carriage. Carrier undertakes to carry passengers and baggage with reasonable dispatch. Times of departure and arrival are not guaranteed and form no part of this contract of carriage. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places in case of necessity. Times of operation are subject to change without notice. Carrier assumes no responsibility for making connections. Passenger seating assignments, if any, are subject to change to accommodate the needs of passengers with disabilities or for operational reasons. Passengers shall comply with Government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by carrier. No employee, agent or representative of carrier or any other party has authority to alter, modify or waive any provision of this contract of carriage. CARRIER RESERVES THE RIGHT TO REFUSE CARRIAGE TO ANY PERSON WHOSE CONDITION CREATES A HAZARD TO HIMSELF OR OTHERS.
5. Passenger Check-In. Carrier recommends arriving at the airport 2˝ hours prior to scheduled time of departure. You must check in at the designated location at least two hours prior to your scheduled time of departure; if you do not, your transportation for that segment is subject to cancellation. You must be in the boarding area 45 minutes prior to scheduled departure. The aircraft doors will close 10 minutes prior to scheduled departure. A valid government-issued photo identification, such as a driver’s license or passport, is required upon check-in for any passenger age eighteen (18) or over. For international travel, at time of boarding, each passenger must be in possession of a valid passport and all other required travel documents or boarding will be denied.
6. Prohibited Carry-On Articles. Passengers are prohibited from taking liquids, gels, and/or aerosols through security screening checkpoints EXCEPT one clear transparent resealable 1-quart (1-liter) plastic bag containing liquids, gels and/or aerosols in containers of 3 ounces (90ml) capacity or less per container that fit easily in the bag. The plastic bag must be completely closed/sealed and subjected to x-ray inspection. Liquids (including juice) or gels for diabetic

or other medical needs, medications, and baby formula and baby food in containers, if a baby or small child is traveling, not contained in a clear transparent re-sealable 1 quart (1 liter) plastic bag or over 3 ounces (90ml) may be carried onboard but must be declared to security personnel at the screening checkpoint. Breast milk is in the same category as liquid medications. A mother flying without her child will be permitted to bring breast milk through the checkpoint, provided it is declared prior to screening.
7. Checked and Carry-On Baggage Limitations. Each passenger is ordinarily permitted to check up to two pieces of baggage. The total outside dimensions (length + width + height) of each piece of checked baggage may not exceed 80 inches. Each passenger is allowed to board the aircraft with one piece of carry-on baggage plus a small personal article such as a purse or briefcase in his or her possession. Total outside dimensions (length + width + height) of the carry-on bag may not exceed 45 inches, and the bag must fit under a passenger seat or in an enclosed overhead bin. Items such as jewelry, cash, electronics, business documents, prescription drugs, car keys, house keys, irreplaceable photographs and similar items should not be placed in checked baggage but should be kept in the passenger’s personal possession at all times. Under no circumstances may hazardous materials, dangerous goods, or articles that may not lawfully be brought into the country of destination be included in checked or carry-on baggage, or otherwise transported.
8. Fragile and Perishable Items. Carrier will accept as baggage the passenger's personal property subject to the above and the following conditions: (a) All baggage including its contents is subject to inspection. (b) Carrier will accept cloth, canvas, vinyl and other soft-sided bags as checked baggage but accepts no responsibility or liability for damage to such baggage or its contents. Soft-sided baggage will be accepted only upon execution by the passenger of a release of liability at airport check-in. (c) Carrier will accept as baggage such personal property as is necessary or appropriate for the wear, use, comfort, or convenience of the passenger on his or her trip. (d) Fragile items: (1) The following classes of items are fragile or perishable or otherwise unsuitable as checked baggage and are subject to the conditions set forth in subparagraph (2) below: eyeglasses and contact lenses not in a case; electronic items, including televisions, radios, phonographs, computers, and tape recorders; musical instruments of all kinds; ornamental items, including jewelry, wigs, wig boxes, antiques, silverware, clocks, and watches; artistic items, including paintings, prints, rugs, and statuary; photographic items, including cameras, tripods, and lenses; recreational items, including skis, tennis rackets, golf clubs, and camping equipment; sporting and mechanical items, including motorbikes, bicycles, and typewriters; items made of paper, including decorations, manuscripts, books, personal papers, and business documents; perishable or edible items, including fruits, vegetables, chocolates and dairy products; live plants; perishable chemical products, including film and x-ray-plates; light sensitive materials; and all medicines, drugs and toiletries. (2) The above-listed fragile and perishable items may be accepted for transportation as checked baggage if they are appropriately packaged in an original factory-sealed carton, cardboard mailing tube, or container or case designed for shipping such items and packed with protective internal material. Perishable and fragile items which are not appropriately packaged or are otherwise unsuitable as checked baggage may be accepted only upon execution by the passenger at airport check-in of a release of liability.
9. Damage, Delay or Loss of Baggage. Claims for delayed or damaged bags or their contents should be made at the arrival airport before leaving the airport. Carrier is not liable for any damage that results from an inherent defect, quality or vice of the baggage. In that respect, luggage by nature is designed to contain and protect its contents; Carrier is not responsible for, and no claim will be accepted for, any damage to luggage that does not impair this ability, or any damage caused by normal wear and tear on the luggage.
10. Notice to Carrier of Any Claim. Notwithstanding any other provision of this contract of carriage, to the maximum extent permitted by law, no action shall be commenced for loss of, damage to or delay in delivery of property or baggage or on any other claim including personal injury or death arising out of, or in connection with, transportation furnished by carrier, or for failure to transport any passenger, property or baggage, unless notice of the claim is presented in writing to carrier within seven days from the date of receipt of baggage in the case of a claim for baggage or property delay or damage; or 21 days from the date of flight arrival in the case of a claim for lost baggage or property; or 21 days after the alleged occurrence in the case of any other claim. Further, to the maximum extent permitted by law, any legal action for recovery of damages shall be barred unless such action is commenced within two years after the alleged occurrence.
ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATION OF LIABILITY
Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of a treaty known as the Montreal Convention may be applicable to the entire journey, including any portion entirely within the country of origin or destination. For such passengers on a journey to, from, or with an agreed stopping place in the United States of America, the Convention provides (1) that the liability of carriers including Omni Air International for death of or personal injury to passengers of up to 100,000 Special Drawing Rights (equal to approximately $150,000) per passenger shall not depend on negligence on the part of the carrier, and (2) such liability shall be limited to 100,000 Special Drawing Rights (equal to approximately $150,000) per passenger in the absence of negligence or other wrongful act or omission on the part of the carrier. Additional information on Special Drawing Rights is available at www.imf.org. For such passengers on a journey not to, from, or having an agreed stopping place in the United States of America, liability of the carrier including Omni Air International for death or personal injury to passengers is limited in most cases to approximately U.S. $10,000, $20,000 or $75,000. In all cases additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier’s liability under the Montreal Convention or other international treaties or agreements. NOTICE OF BAGGAGE LIABILITY LIMITATIONS: INTERNATIONAL AND DOMESTIC
Liability for loss, delay, or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. For international travel (including domestic portions of international journeys) to, from, or with an agreed stopping place in the United States of America, the liability limit is 1,000 Special Drawing Rights (equal to approximately $1,500) per passenger for all baggage, including carry-on. Additional information on Special Drawing Rights is available at www.imf.org. For international travel (including domestic portions of international journeys) to which the Montreal Convention does not apply, the liability limit is approximately U.S. $9.07 per pound ($20.00 per kilo) for checked baggage and $400 per passenger for unchecked baggage. For travel wholly between U.S. points, Federal rules require any limit on an airline’s baggage liability to be at least $3,300 per passenger. Excess valuation may be declared on certain types of articles. Some carriers assume no
Omni Air International (OMNI) will not discriminate on the basis of disability in air travel and requires its authorized representatives and agents to accommodate the needs of passengers with disabilities.
- OMNI will not refuse transportation to people on the basis of disability. We may exclude anyone from a flight if carrying the person would be inimical to the safety of the flight. If we exclude a person with a disability on safety grounds, we will provide a written explanation of the decision.
- OMNI will not require advance notice that a person with a disability is traveling. We require up to 48 hours’ advance notice for certain accommodations that require preparation time (e.g., respirator hook-up).
- OMNI will not limit the number of disabled persons on a flight.
- Omni will not require a person with a disability to travel with an attendant, except in certain limited circumstances specified in the rule. If a disabled passenger and the carrier disagree about the need for an attendant, we can require the attendant, but cannot charge for the transportation of the attendant.
- OMNI will not keep anyone out of a seat on the basis of a disability, or require anyone to sit in a particular seat on the basis of a disability, except as an FAA safety rule requires. FAA's rule on exit row seating says that we may place in exit rows only persons who can perform a series of functions necessary in an emergency evacuation.

Check-in Guidelines
Before the Airport
- Do not pack or bring Prohibited Items to the airport. Visit www.TSATravelTips.US for a complete list.
- Place valuables such as jewelry, cash and laptop computers in carry-on baggage only. Tape your business card to the bottom of your laptop.
- Avoid wearing clothing, jewelry and accessories that contain metal. Metal items may set off the alarm on the metal detector.
- Avoid wearing shoes that contain metal or have thick soles or heels. Many types of footwear will require additional screening even if the metal detector does not alarm.
- Put all undeveloped film and cameras with film in your carry-on baggage. Checked baggage screening equipment will damage undeveloped film.
- Declare firearms & ammunition to your airline and place them in your checked baggage.
- If you wish to lock your baggage, use a TSA-recognized lock.
- Do not bring lighters or prohibited matches to the airport.
- Do not pack wrapped gifts and do not bring wrapped gifts to the checkpoint. Wrap on arrival or ship your gifts prior to your departure. TSA may have to unwrap packages for security reasons.
At the Airport
Each adult traveler needs to keep available his/her airline boarding pass and government-issued photo ID until exiting the security checkpoint. Due to different airport configurations, at many airports you will be required to display your boarding pass more than once.
Place the following items IN your carry-on baggage or in a plastic bag prior to entering the screening checkpoint:
- Mobile phones
- Keys
- Loose change
- Money clips
- PDA's (personal data assistants)
- Large amounts of jewelry
- Metal hair decorations
- Large belt buckles
- Take your laptop and video cameras with cassettes OUT of their cases and place them in a bin provided at the checkpoint.
- Take OFF all outer coats, suit coats, jackets and blazers.

Important Announcement:
The U.S. Transportation Security Administration requires us to advise you that passengers are prohibited from taking liquids, gels, and/or aerosols through the passenger screening checkpoint into the sterile area EXCEPT one clear transparent resealable 1-quart (1-liter) size plastic bag containing liquids, gels, and/or aerosols in containers of 3-oz. Delayed Baggage Policy
Should a passenger arrive at their destination airport on an Omni Air International (OAI) flight and find their baggage has been delayed, the following policy and procedure will apply:
This coverage will begin when the passenger reports non-receipt of baggage to an OAI representative at the destination airport; written report form should be completed by the passenger and returned to the OAI representative before leaving the airport. Coverage will end when the bag is returned to the passenger or OAI determines that the bag cannot be recovered. Coverage applies whether the passenger has traveled on an international or domestic flight.
Up to $25.00 per day is ordinarily sufficient to cover reasonable expenses such as dental supplies, hair supplies, undergarments, etc., resulting from delayed baggage. OAI will consider reimbursement of a larger amount only to the extent proof is furnished that additional expenses were necessarily incurred by the passenger as a result of the delayed baggage. All expenses must be reasonable, actual and verifiable to be considered for reimbursement.
The passenger must purchase all items; cash advances are not possible.
Reimbursement will be handled after passenger’s return, please allow 4-6 weeks for settlement of claim.
Receipts for all items purchased, passenger’s copy of delayed luggage report, itemized OAI claim form, and any supporting information must be submitted in writing for reimbursement to:

Portable Oxygen Concentrator (POC)
POCs are small, portable devices that work by separating oxygen from nitrogen and other gasses in the air and providing the user with oxygen at a concentration of more than 90 percent. The POCs operate using either rechargeable batteries or aircraft electrical power.
Omni Air International will permit utilization of POC's on board OAI aircraft under the following procedures:
- Omni has received the request 48 hours prior of the intended flight
- The passenger has a signed physician's statement, to be kept in that person's possession. The letter must state the following: Whether the user of the device has the physical and cognitive ability to see, hear, and understand the device's aural and visual cautions and warnings and is able, without assistance, to take the appropriate action in response to those cautions and warnings.
Whether or not oxygen use is medically necessary for all or a portion of the duration of the trip. For example, during the entire flight (including aircraft ground delays, movement on the surface (taxi), takeoff, and landing), during only the en route portion of the flight, or only when needed.
The maximum oxygen flow rate corresponding to the pressure in the cabin of the aircraft under normal operating conditions.
The physician's statement must be dated withing 10 days of intended flight.
The POC is one of the 12 POC's currently authorized for use onboard our aircraft
The POC user must then carry on the flight a sufficient number of batteries to power the POC for 150% of the expected maximum flight duration.
